Position Information
I.  Work assignment

Party B’s duty is to teach Japanese language or/and literature to the Japanese majors of the Foreign language College or the students of International Education College to a maximum of 18 class hours (forty-five minutes for each class) from Monday to Friday five days a week, except in situations detailed in Ⅱ Rest and Holidays. As a foreign teacher, Party B is welcome and expected to join the Japanese Corner organized by the students on the campus, but not in the consumption place to be held, any organized activity must be arranged by International & Exchange Cooperation Division.

II.  Rest and holidays

The vacation time of Party B shall correspond to the university’s vacation time and China’s national holidays. Generally speaking, foreign teachers are entitled to enjoy the same holidays as Chinese do. These include most weekends (Saturday and Sunday), the one-day New Year’s Day Holiday (Jan. 1st), the Spring Festival or the winter vacation (about one month), the one-day April 4th Tomb-sweeping Holiday (April 4th), the one-day May Day Holiday (May 1st), the one-day Mid-Autumn Festival (the lunar August 15th), and the three-day National Day Holiday (3 working days).(Note:In order to facilitate consecutive days of the above holiday periods it will be necessary to rearrange weekend and week day work in accordance with Government Policy). Experts are also entitled to the following festivals and holidays corresponding to their nationalities and religions: one day for Christmas, one day for Easter. Work schedules must be arranged to fit in with such holidays, as Chinese do not normally celebrate them.

III. The salary treatment

1. Direct payment

  1) Monetary salary RMB/month: The salary will be paid monthly with RMB from the day of starting work to the expiration of the contract. (During summer vacation, {July and August} while there is no teaching job, the salary is not offered. If Part B after the 10th July leaving and before 25th August arrival, Part B can get extra 3000yuan RMB salary.) In case the time is shorter than a whole month, the payment shall be counted by day. The daily wage shall be 1/30 of the monthly salary. Party B shall pay the personal income tax in accord with the Personal Income Tax Law of The People’s Republic of China.

2) In one academic year,If Part B’s teaching quality evaluation is excellence (score be given by College plus school teaching affairs more than 90 scores, include 90 scores ) will be paid the end bonus about 5000yuan Rmb in all. Except the foreigners who continue teaching from second academic year in our university, or PhD holders. If Part B’s teaching quality evaluation is below 60 scores in one academic year, Part A has the right to Cancel and Terminate of the Contract.

2. Indirect payment

Party A will guarantee the fundamental living conditions for Party B in China:

1) Providing an apartment with furniture, bedding, a telephone, a television, a refrigerator, a kitchen, a micro-wave oven and a set of gas stove, a washing machine, electric water-heater, toilet, air conditioner and a computer and internet. All items provided will be in good repair and maintained by the university.

2) During the term of the contract, public medicare for Party B shall be subsidized by 100% in the university’s hospital on campus and by 50% by Party A in the hospital appointed by Party A (the No. 154 Hospital and the Central Hospital of Xinyang city). Otherwise, the expenses shall be covered by Party B. Expenses for registration, transportation for medicare, massage, tooth inlaying, cleaning teeth, undergoing cosmetic surgery, buying spectacles, boarding in hospital and non-medical tonics man-made accident of Part B shall be covered by Party B.

3) Party B shall enjoy 2,200 yuan RMB (namely vacation travel allowance, half of the total of which is to be given to Party B at the end of each semester). Party B should be responsible for all his\her personal actions (including his\her personal safety) in his\her trips outside the campus, which is arranged by himself\herself.

4) Party A shall pay Party B 5,000 yuan RMB for a round-way int’l flight (direct economy route) in RMB cash---half to the end of the first semester, and the other half near the end of the contract(but the tax 270RMB must be paid by Part B).

5) Party A shall pay Part B’s safety insurance(600 yuan RMB in total).

IV. Sick leave and private affairs leave

1. If Party B asks for sick leave, after 30 consecutive days of absence, he\she should present a doctor’s certificate. His\her salary should be paid with 100% of the salary if the sick leaves amount to less than 30 days within one contract term (one academic year). In case the leaves exceed 30 successive days, Party A has the right to terminate the contract, or, if Party A does not propose termination of the contract, Party B shall receive 70% of his\her salary from the thirty-first day until the day he\she resumes regular work or to the expiration of the contract.

2. During the term of the contract, the medical care expenses of Party B in the hospital appointed by the local government during business errands shall be paid by Party A; the medical expenses incurred during private travels shall be covered by Party B.

3. Part B, on occasion of any private affairs leave, should and must hand in his\her leave permit to both IECD and his\her teaching unit, before he\she leaves the university. In leave permit he\she must clearly indicate how long he\she will be away and also leave his\her contact means to both IECD and his\her teaching unit. It must also be pointed out that Part B shall be totally held for any undesirable or unexpected incident or accident befalling on him\her, where he\she is on private business, having nothing to do with Part A. Party A will deduct the salary by working day (each day being one thirtieth of a monthly salary). In the contract term (one academic year), the private affairs leaves should not exceed 10 days. If the private affairs leaves exceed 10 days, Party A has the right to terminate the contract and investigate liability of Party B for violation of the contract.

   4. In case of absence from work without Party A’s permission, one day’s salary will be deducted for each day absent. For serious circumstance, Party A has the right to terminate the contract and investigate liability of Party B for violation of the contract.

V. Responsibilities of Party B

1. Party B, upon arrival in the university, shall have a medical examination in the local authorized Quarantine Bureau and the expenses so incurred should be covered by Party B. On condition that Party B had already done a physical examination in the authorized hospital in his/her home country and had also submitted to Party A the medical report before entering China, then the physical examination cost in China will be covered by Party A.

2. He\she will cover the expenses of visa, and Party A will cover the expenses of “temporary residence permit for foreigner” (800 yuan RMB).

3. Party B shall use house facilities properly and economically.

4. Party B pays his\her own food, phone bills, and Party A will cover the expenses of water and electricity bills (300yuan RMB, but not in cash. if the expenses of water and electricity bills in one month more than 300yuan, Part B need to pay over-expenditure). In summer vacation and winter vacation Part B need to pay the expenses of water and electricity bills by themselves.

VI. The probation period of the Contract

   The probation period of Party B shall be 60 days. In the probation period, if Party A finds out that Party B is unfit for the assignment specified in the contract for reasons of health or professional ability, it has the right to terminate the contract.

VII. Both parties shall sign the appendix of the contract immediately upon agreement.

VIII. Confirmation and change of each term of the appendix of the standard contract must be stipulated in written form through negotiation between the two parties. Any oral agreement will be regarded as invalid.

This appendix has equal validity of the standard contract and comprises an integral part of the contract.
