Position Information
The Appendix of the Standard Contract
For Foreign Cultural and Educational Teachers

The Host Institution:  This University 
The Employed Party: 

I. Work Assignments
  1. The employed is to work at the secondary colleges for teaching Oral English, English Writing or other courses. The basic job is to teach 16 - 18 periods a week, and to open at least one selective course which orients to all students in the university. If the employed wants to increase the class, both can consult with each other.
  2. The employed should submit the semester’s teaching plan, contents, and schedule to the Department a week before the beginning of each semester. And the employed must carry out the teaching activities according to the schedule.
  3. The employed should ask the permission from the dean of the Department when he or she wants to use his or her own teaching materials, such as films, video tapes and so on. Any content prohibited by the Chinese Constitution and Law can’t be used as teaching materials, and illegal religious activities are not allowed. 
  4. The employed party’s teaching will be supervised, checked and evaluated by the Department who is responsible for it. The evaluation can be performed through various means such as attending to class without any notice, finding out teaching feedback from the students with questionnaires, asking the opinions from teachers and students, and the mid-term teaching assessment. 
  5.The employed party should abide by the work time of the institution, well prepare and teach lessons, check students’ homework carefully, allot adequate time to tutor students after class, take part in the English Corner at least once a week and give one academic lectures for each semester.
  6. The employed can also take part in some public welfare activities and other social activities after getting the permission from the International Exchange and Cooperation Office.

II. The Salary Treatment
  1. The direct monetary salary
  The salary will be paid monthly with RMB by host institution. The monthly monetary salary is 6000 Yuan. In case the time is shorter than a whole month, the payment shall be counted by number of the working days. The daily wage shall be 1/30 of the monthly salary .The direct time to pay salary is by the end of each month. According to the Standard Contract, Sichuan University of Arts and Science will employ               in September 1st, 2016 to July 20th, 2017. The employed shall pay the personal income tax in accordance with the personal Income Tax of the People’s Republic of China. The tax is to be paid by the employed party. But the tax threshold is over 4800RMB.
  2. The other indirect payment
  The host institution will guarantee the fundamental working and living conditions for the employed party in this university during the contract term.
  (1) The host institution provides lodging with furniture, bedding, telephone, television, refrigerator, air-conditioner, water heater, washing machine, kitchen, toilet, and dishware ect. 
  (2) The employed is sure to go to teaching by taking the school shuttles from the old campus to the new one. The host institution will not give the transportation allowance.
  (3) The transportation expenses of reference books, teaching materials, luggage, and teaching apparatus etc., which are needed in the specified work and approved in advance by the host institution, can be paid by the employer according to invoice or receipt.
  (4) During the contract term, the host institution will buy a medical insurance and an accident insurance for the employed.
  (5) The host institution provides the economy class air ticket from Hunan to Chengdu or Chongqing, and train ticket or bus ticket to Dazhou from Chengdu or Chongqing. If the employed works in the host institution more than two years, the host institution will provide the economical class return airplane ticket. If the employed party does a good job during the contract term, the host institution will consider provides a part of the allowance of the return ticket about 2000RMB. After working in the host institution for more than two years, and if the employed will go to work in other places in China, the host institution will provide the train ticket for the employed. If the employed doesn’t complete the contract and leaves in midway, the host institution will not provides return expenses.
(6) If the employed suffers from disease, meets with unexpected injuries or dies from unavoidable natural calamities, the host institution will not be responsible for them.

III. Work Time, Rest and Holidays
  1. The employed is to work 5 days a week in light of the host institution’s work time. If the host institution changes the work time because of something special, the employed party should also change the work time as our other college teachers do, while the salary will be neither increased nor reduced because of such changes.
  2. The employed is entitled to be off work during New Year’s Day, Spring Festival, Labor’s Day, National Day, apart from his own national holiday Christmas.
IV. Sick Leave and Private Affairs Leave
    1. When the employed asks for sick leave, he/she should show the director of International Exchange and Cooperation Office certificates from doctors of the central hospital or other county-level or higher-level hospitals. The employee should get the director’s permission and fill in a leave request in International Exchange and Cooperation Office for record. If the total time of sick leave is less than 30 days within one contract term, the host institution shall pay 100% of the salary. In case the leave exceeds 30 days and the employed party can’t recover his/ her health for the normal work, the host institution has the right to terminate the contract. Or if the employed restores the normal work after more than 30 days of sick leave, the host institution just pay 70% of the agreed salary for the time beyond the 30 days’ limit.
  2. If the host institution finds he or she suffers from serious chronic diseases and cannot continue his or her normal work, the host institution has the right to terminate the contract, and the employed party can’t work and live in the host institution.
  3. If the employed has to leave for private affairs, he/she should first get permission from the International Exchange and Cooperation Office. The host institution will deduct the salary by day. In the contract term, the private affairs leave should not exceed 10 days. The continuous private affairs leave shall be no more than 3 days (excluding the weekend). And two-day salary will be deducted for each day beyond the limit.
  4. The employed party must write a regular paper about private affairs leave and the sick leave to the International Exchange and Cooperation Office. In case of absence from work without the host institution’s permission, the host institution will deduct 3-day’s salary for each day absence. For serious circumstances, the host institution has the right to terminate the contract and investigates the liability of the employed party for violation of the contract. 

V. Equipment and Furniture Management
  The host institution will provide lodging and furniture, cooker, bedding, etc. The property and the utensils belong to the host institution. The employed should take good care of the equipment, save water and energy sources. If the employed breaks any equipment, he or she should compensate. The employed is allowed to use at most 50 tons of running water, 300 degrees of electricity, 50 cubic meters of gas. The employed should pay the extra money resulting from going beyond the limits.

VI. Rewards
    1. To those foreign teachers who have made great achievements in their work, the host institution will reward them with merit certificates titled with Advanced Worker or Distinguished Teacher in the institution’s name and commemorative gifts.
2. During the contract term, if the employed party strictly abides by the contract, successfully fulfills the job and wins popularity among the faculty and the students, the host institution will give the employed party certain amount of money for traveling and organize traveling around the neighboring scenic spots and historical sites at the end of the contract. If the employed part has done a good job under the contract of one year, the host institution will give him/her 2000 RMB travel allowance. The travel allowance is 2000 RMB for a year of contract term.

VII. The Probation Period of the Contract 
  1. Confirmation and change of every term of the appendix of the standard contract must be stipulated in written form through negotiation between the two parties, any oral agreement will be regarded as invalid.
  2. In case the employed party requires signing a new contract at the end of the contract term he or she should propose to the host institution thirty days before the expiration of the original contract and the new contract should be signed with both parties’ agreement through consultation. However, if the employed wants to stay in China after the end of the contract term, he/she should be responsible for all the costs and expenses.

VIII. This appendix and the Standard Contract are inseparable and they both make up an integrated whole, so they each have the equal legal validity. The appendix has five copies with both Chinese and English versions. If both parties have any misunderstanding resulting from the English version of the Chinese Contract, the final interpretation should be given in the light of the original Chinese Contract.

IX. This contract takes effect on the date it is signed by both parties.
