Contract Enclosure

Party A : This College

Party B : 

This contract is made in a spirit of friendly cooperation by and between Party A and Party B, whereby both parties agree to fulfill the contract on the terms and conditions stipulated as follows:

I. The Qualifications of Party B:

1. Party B should have a bachelor’s degree or over and have certain teaching experience.

2. Party B should be healthy and must offer the health certificates issued recently by foreign hygiene medical organizations legalized by Chinese embassy or consulate or by Health Quarantine 

Department which Chinese Government appoints. The cost shall be at Party B’s expense.

 

II. Party B’s Obligations

1. Party B shall observe the college’s regulations and principles，working system and teaching arrangement enacted by the college and shall not interfere in the college’s internal affairs.

2. Party B shall agree to finish the teaching task that Party A arranges. And the work undertaken every week does not exceed 16 class periods(include16).

3. Party B shall undertake teaching activity, teaching material writing and modification, teaching recording and answering questions etc. arranged by Party A.

4. Party B shall not be absent, late and leave early from class without informing the Teaching Affairs Office and the International office in advance.

5. Party B shall make up for the classes delayed because of being absent of leave and is not allowed to ask others to have classes instead without permission.

6. Any requests for teaching, lecturing, translating, taping, advertising, language contest judging or other services that are out of his/her regular workload MUST be approved by Party A. Any 

commercial activities including setting up a business are forbidden.

7. Free time (i.e. after class or during holidays) is at Party B’s disposal. If Party B plans to travel outside of Heze, a written notice including emergency contact information and a travel 

itinerary needs to be presented to the designated staff of International Office and Party B’s co-teacher at least one day in advance before his/her departure. When Party B returns to Heze, he/she 

shall go through the temporary residence registration procedures for foreigners within 24 hours of arrival.

8. When the contract ends. Before leaving, Party B shall return the books from the library and all others belonging to the college.

 

III. Pay for Party B

1. Salary

Party B’s month salary is RMB 8000 yuan, it will be paid around the tenth of next month. Salary is paid monthly and consecutively during the term of the contract. Party B shall pay personal income 

tax in accordance with the Law to Pay Individual Income Tax of People's Republic of China.

1) Salary is provided monthly and, if the working is less than a month, the pay is provided according the actual working days. The daily pay is 1/30 of monthly pay.

2) Paid holidays: Party B can enjoy 4-5 weeks paid holidays (one month’s salary) after the task is finished in the first term if contract duration is one year. Holiday time is arranged according 

to teaching plan by Party A. 

2. There are a two-day holiday for Christmas Day (December 24 and December 25), and Party B needn't make up missed classes for the above festivals or holidays.

3. Travel 

1) Before coming to China, Party B should, after consulting with Party A, 

purchase his/her flight ticket to China (economy-class seat from the nearest airport in Party B’s home country to Heze) as credit bail. 

2) If Party B completes his/her tasks successfully, Party A shall provide

Party B with a return flight ticket (economy-class seat from Heze to the nearest city in Party B’s country).

3) If Party B terminates the contract early due to personal reasons, he/she 

is responsible for his/her own return flight ticket and transport fare between cities.

4) For reimbursement of flight tickets, Party B must submit the

reimbursement form along with the boarding pass stubs, full detailed travel itinerary and the ticket receipt.

 

4. Lodging

1) Party A offers one flat with two-bedrooms for Party B (including the case that both husband and wife are Party B). The flat is furnished with necessary furniture, television, microwave oven, 

refrigerator and air conditioner.

2) Water, electricity, heating system, gas and internet is offered free. 

3) Without Party A’s permission, Party B is not allowed to let anyone else to stay overnight in the appointed apartment. Visiting spouse, children, and other immediate family can stay with Party B 

during the visit after notifying Party A and must complete check-in procedures and go through the temporary residence procedures for foreigners according to the relevant laws and regulations. 

4) Party B should follow the property management regulations of the university and property management companies about the usage of public areas and facilities, and the maintenance of public order 

and environment.

5. Medical Service

1) If Party B asks for leave and can't have a class due to illness, Party B shall offer the doctor’s diagnoses certificate, and the leave shall be approved by Foreign Affairs Office. Party B shall 

go to College Clinic for health problem first. Party B shall not go outside the College to seek medical service and purchase medicine without approval, the cost shall be at Party B’s expense. The 

medical expenses shall be paid by both parties, and Party A pays 40%.

2) Items that are at Party B’s expenses: fee of doctor’s visiting at home, traffic for medical service, medical registration, injection, tooth prosthetics, washing teeth, face-lifting, keep-fit 

massage, buying glasses and the taking of nourishing medicines, treatment of the already existing chronic disease (old age disease and liver diseases, etc.) and the medical service outside the 

college without approval etc.

6. Party A shall bear the costs of processing fees for Visa, Residence Permit, and Physical Examination; and travel-accident insurance. 

Ⅳ. Execution of the Contract

1) The modification and change of any clause of this contract enclosure must be consulted by both parties in written form, and any oral contract is regarded as invalid.

2) Any unfinished clauses concerned with the contract enclosure shall be put forward by Party B and solved through negotiation.

3) The contract enclosure has the same effectiveness with the standard contract and is one part of the contract.

4) Both parties release from the engagement relation automatically when the contract expires.

 

Ⅴ. Contract Probationary Period

There is a 60-day probationary period to Party B. During the probation, Party A has the right to cancel the contract in condition that Party B has healthy problem or professional level and can not 

be competent with the work. Party A does not pay any penalty or round ticket.

This contract is in duplicate, and each one is written both in Chinese and English. The two kinds of language contact are equally valid. Both Party A and Party B keep one copy.
